Terms of Service

Kanily Technologies LLP ("us", "we", or "our") operates this website and the Chips of Fury software application (the "Service").

This page informs you ("user" or "player") of the legal terms and conditions for using our Service. If you do not agree to these terms, please discontinue use of our service.

Disclaimer

This software is for entertainment only. All gameplay on "Chips of Fury" uses virtual chips which have no real monetary value. Any exchange of real money based on the outcome of the game is done at your own risk. The user assumes full responsibility for respecting the laws/restrictions of your country/state (including international laws) or legal permission to play online poker.

Purchases

If you wish to purchase any product, feature or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address etc.

We do not store your credit card information.

• You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
• By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
• We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
• We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
• Purchases in the iOS and Android apps are made through the App Store or Google Play, which process the payment.
• If you are under 18, or under the age of majority where you live, you need a parent's or guardian's permission to make purchases. Parents can require approval for purchases with Ask to Buy on iOS and with purchase approvals in Google Play.

Fury Bucks

Fury Bucks are the in-app currency of Chips of Fury. You can buy packs of Fury Bucks in the iOS and Android apps, and we may also give Fury Bucks as rewards. You spend them in the app, on items in the shop and on Table Passes. If we rename Fury Bucks, these terms apply to them under the new name.

• Fury Bucks have no cash value. You can't exchange them for money or for anything outside the app, and we don't buy them back, except for the refunds described under Refunds.
• Fury Bucks are separate from chips. You can't bet Fury Bucks at a poker table, turn them into chips, or win or lose them in a game.
• Fury Bucks belong to the Chips of Fury account that bought or received them. You can't transfer, gift, sell or trade them, or move them to another account. They stay with that account even if your App Store or Google Play purchases move to a different Chips of Fury account.
• Fury Bucks don't expire.
• We take Fury Bucks from your balance only when you confirm a purchase, at the price shown when you confirm.
• We don't reduce your balance except as these terms describe: a refund, the correction of a mistake, or the closing of your account.
• If we add Fury Bucks or an item to your account by mistake, for example twice for one purchase, we may correct it.
• Fury Bucks pack prices are set per country and may change. Prices in Fury Bucks may also change. Neither affects Fury Bucks already in your balance or items you already own.

Items from the Shop

The shop sells cosmetic items, such as avatars, card decks and table felts, and bundles of them. Cosmetic items change how things look and give no advantage in a game. The shop may also offer other items.

• Buying an item gives your Chips of Fury account the right to use it in the app. You can't transfer, sell or trade items.
• Items stay in your account for as long as we run the Service. We may update an item's artwork. We don't remove items you own except as these terms describe.
• Some purchases in the App Store or Google Play, such as supporter tiers, add items to your account directly. If such a purchase is refunded, we remove the items it added.

Availability, Errors and Inaccuracies

The service is offered "as is" and provided with no warranty of any kind. We are not liable for any damages or losses arising from the use of the service. We do not guarantee that the service will be available at all times or that it will be free of errors or defects.

We may update, change or discontinue the Service or any of its features.

Limitations of Liability

We will not be liable for any damages or losses arising from your use of the Service, including but not limited to bugs, hacks, or other errors in the Service. You may use the Service at your own risk.

Refunds

Refunds for purchases in the iOS and Android apps follow the store's rules:

• App Store: request a refund from Apple at reportaproblem.apple.com. We can't issue App Store refunds ourselves.
• Google Play: contact us and we will review your request.
• If a purchase did not go through as expected, contact us and we will look into it.
• Subscriptions can be cancelled at any time in the Settings app on iOS or the Google Play app on Android. Cancelling stops the next renewal, and PRO stays active until the end of the period you paid for.

Fury Bucks packs:

• When a store refunds a Fury Bucks pack, we remove that pack's Fury Bucks from your balance.
• If you have already spent some of those Fury Bucks, your balance can go below zero. While it is below zero you can't spend Fury Bucks; buying or earning Fury Bucks brings it back up. Items and Table Passes you already bought are not taken back.
• Consumers in the EU, the EEA and the UK may have a legal right to withdraw from a purchase within 14 days. For App Store purchases, Apple handles withdrawals. For Google Play purchases, contact us.

Nothing in these terms limits the rights you have under the consumer laws where you live.

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content subject to these Terms.

You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Accounts

Your account is what allows you to use the Service. You are responsible for maintaining the confidentiality of your account and for any activities or actions under your account. You agree not to disclose your account credentials or allow anyone else to use your account. You must immediately notify us if you feel that your account has been compromised or has been used in fraudulent activities or other unlawful activities.

If you delete your account, its Fury Bucks and items are deleted with it. They can't be restored, moved to another account or refunded, so spend any Fury Bucks you want to use first. We keep records of your purchases for as long as we need them for accounting and refunds.

Termination

We may suspend or close your account at our discretion, for example if you break these terms or the law. You can ask us to review the decision through our contact page. If we close your account, its Fury Bucks and items are lost, as when you delete it yourself.
